Terms of Service

These Terms of Service ("Terms") govern your use of ScrapingLab ("the Service"), operated by ScrapingLab. By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Account

To use the Service, you must create an account. You are responsible for:

  • Providing accurate and complete registration information
  • Maintaining the security of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access

You must be at least 18 years old to use the Service. You may not use another person's name, trademark, or entity name without authorization.

2. Description of Service

ScrapingLab is a web scraping platform that allows users to create automated workflows to extract data from websites. The Service includes a visual workflow builder, task scheduling, data extraction, screenshot capture, and export capabilities.

3. Acceptable Use

You agree to use ScrapingLab responsibly and in compliance with all applicable laws. You must not:

  • Scrape websites in violation of their terms of service when doing so would be unlawful
  • Collect personal data in violation of privacy laws (GDPR, CCPA, etc.)
  • Use the Service to harass, spam, or harm others
  • Distribute malware or other malicious content through the Service
  • Attempt to circumvent rate limits, access controls, or security measures on the platform
  • Attempt to gain unauthorized access to any systems or networks
  • Resell or redistribute access to the Service without written permission

4. Web Scraping Guidelines

ScrapingLab is a tool. You are solely responsible for how you use it and the websites you choose to scrape. When using the Service, you must:

  • Respect robots.txt files and website terms of service
  • Implement reasonable rate limiting to avoid overloading target servers
  • Not scrape personal data without a lawful basis
  • Take full responsibility for the legality of your scraping activities in your jurisdiction

5. Your Data

You own the data you extract using ScrapingLab. You retain all rights to the workflows you create. You grant us a limited license to process and store your data solely to provide the Service.

You are responsible for ensuring you have the right to collect and use the data you extract. We are not responsible for how you use scraped data.

6. Subscription and Payment

Paid subscriptions are billed in advance on a monthly or annual basis. Payments are non-refundable except as required by law or at our sole discretion on a case-by-case basis.

Credits included in your plan:

  • Do not roll over to the next billing period
  • Cannot be transferred between accounts
  • Vary based on your subscription plan

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. We may change pricing with 30 days advance notice.

7. Service Availability

We aim for high uptime but do not guarantee uninterrupted service. The Service is provided on an "as is" and "as available" basis. We may perform maintenance with advance notice when possible. We are not liable for data loss caused by third-party website changes, downtime, or circumstances beyond our control.

8. Intellectual Property

ScrapingLab and its original content, features, design, and functionality are owned by ScrapingLab and protected by intellectual property laws. The workflows you create and the data you extract belong to you.

9. Content and Backups

You are responsible for the content you create and process through the Service, including its legality, reliability, and appropriateness. While we perform regular backups, we do not guarantee against data loss or corruption. You agree to maintain your own backups of critical data.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SCRAPINGLAB SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of data, profits, or business opportunities
  • Service interruptions or errors
  • Actions taken by third-party websites
  • Loss of privacy arising from use of the Service

Our total liability shall not exceed the amount you paid for the Service in the twelve months preceding the claim, or $100 USD, whichever is greater.

11. Indemnification

You agree to indemnify and hold harmless ScrapingLab from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Copyright and DMCA

We respect intellectual property rights. If you believe content on the Service infringes your copyright, contact us through the support channel available in your account with a detailed description of the alleged infringement. We will take appropriate action in accordance with applicable law, including the Digital Millennium Copyright Act (DMCA).

13. Termination

You may cancel your account at any time. We may suspend or terminate accounts immediately, without prior notice, for violation of these Terms or for any reason at our sole discretion.

Upon termination, your right to use the Service ceases immediately. Your data will be deleted in accordance with our Privacy Policy retention schedule.

14. Governing Law and Disputes

These Terms shall be governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. If you have a dispute about the Service, you agree to first attempt to resolve it informally by contacting us.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through the Service at least 30 days before they take effect. Continued use of the Service after changes constitutes acceptance of the new Terms. If you do not agree to the updated Terms, please stop using the Service.

16. Severability

If any provision of these Terms is held to be unenforceable or invalid, that provision will be modified to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
